She is admitted to the Bar in New York (1989), Massachusetts (1989), and Israel (1993). Ms. Schechter graduated with a B.A. in Politics in 1983 from Brandeis University and received her J.D. in 1989 from Suffolk University Law School. She is an adjunct instructor at Bramson Ort College in the Paralegal and Business programs. Throughout her 23 year career, Ms. Schechter has practiced in secular courts and Batei Din (Jewish religious courts). She began her career as a public defender with the New York Legal Aid Society, Criminal Defense Division. Presentation 4- by Shlomo Steinman Esq Estimated time for presntation 20-25 minutes Tax Problems (IRS & State) Failure to Pay Always file w/IRS even if you can’t afford to pay, since the IRS will often assess an amount if you earned anything, not necessarily in your favor Don’t Ignore Letters from IRS- or you can lose rights Can be Subject to: Liens Levies Wage Garnishments Potential Solutions Installment Payment or Partial Pay Installment Agreement Currently Non-collectible Status Still accrues interest Offer in Compromise Situation must appear dire IRA assets can be seized by IRS/used for payment of tax debt This does not deal with trust fund taxes (unemployment, social security taxes not turned over by business owners Viewed as stealing money from IRS having been paid by employees Foreign Bank Accounts (FBAR Requirements) U.S. citizens or residents with either a financial interest in, or signature authority over foreign financial accounts, whose total value exceeds $10,000 at any time during the previous calendar year must generally file the FBAR by June 30th of the following year. Schedule B of the 1040 asks if you had financial interest in foreign account and instructs you to file Form TD F 90-22.1, commonly referred to as “FBAR” Failure to do so, when required can subject one to significant penalties Up to 50% of the highest value in account per year plus civil penalties of 20 – 75% Perjury if you claimed on Schedule B you didn’t have foreign account (criminal?) Voluntary Disclosure Program 27.5% Penalty plus be ready to become fully compliant for previous years (amend previously filed returns, and be ready to pay requisite tax, etc. If you paid the tax but did not file the FBAR, you don’t need to enter voluntary disclosure – just file form FATCA - Other accounts (i.e. brokerage) over $50,000 Non-Profits Basics of filing Public Charity Private Foundation.
